1. PURPOSE OF THE AGREEMENT
This legally binding Agreement is entered into between Emmanuel Mercy Mission (EMM) and the Recipient Organization (Partner). The purpose of this document is to establish strict compliance, legal protocols, and transparency requirements regarding the receipt, tracking, distribution, and reporting of all Humanitarian Aid and Gift-In-Kind (GIK) products provided by EMM.
2. STRICT CHARITABLE USE & COMPLIANCE
In accordance with United States federal law and IRS regulations governing 501(c)(3) public charities, the Recipient Organization strictly agrees to the following terms:
- Exclusive Charitable Purpose: All products, medical supplies, clothing, winterized materials, equipment, or monetary funds received from EMM must be used exclusively for charitable purposes for the treatment of the ill, needy, or disaster victims.
- No-Cost Distribution: All received items must be distributed to individuals in need completely free of charge. Under no circumstances may a patient or recipient be billed, co-charged, or requested to donate in exchange for aid.
- Prohibition of Commercialization: Products received from EMM shall not be sold, transferred to commercial entities, bartered, or exchanged for services, goods, or political favors.
3. ACCOUNTABILITY AND REPORTING REQUIREMENTS
The Recipient Organization commits to providing comprehensive Feedback Reports within 30 days of receiving any shipment or funding:
- Logistics Verification: Written confirmation detailing the exact date, location, and condition of the received shipment upon arrival.
- Distribution Records: Clean, transparent records indicating how the donations were split, which communities or churches received them, and how many individuals were assisted.
- Media & Verification Material: Submitting high-quality verification materials, including clear videos, high-resolution photographs, field stories, media links, and signed letters of thanks from the final recipients.
4. INFORMATION SHARING & MEDIA AUTHORIZATION
The Recipient Organization explicitly authorizes Emmanuel Mercy Mission to share all submitted applications, financial reports, photos, and feedback materials with EMM's current corporate donors, future board members, and potential public funders for audit and fundraising purposes.
5. LEGAL TERMINATION OF FUTURE AID
By signing below, the Recipient Organization acknowledges that future humanitarian allocations are fully contingent upon strict compliance with this Agreement. Without complete, transparent, and timely documentation, Emmanuel Mercy Mission will legally halt all future aid shipments and product donations.
